Prosecution Withdraws Criminal Charges Against Aisha Fatty

The prosecution today withdrew their criminal charges against Aisha Fatty before Magistrate Krubally of the Banjul Magistrates’ Courts.

Police Commissioner Abdoulie Sanneh, appearing for the state, informed the court that they were applying to withdraw the case pursuant to Section 68(1) of the Criminal Procedure Code in order to “put their house in order.”

Counsel Kadijatou Jallow, appearing for Fatty, told the court that she could have requested costs as she had left the High Court, where her client’s civil case was ongoing, only for the prosecution to withdraw the criminal charges.

However, Jallow said that she was not opposed to the withdrawal of the case and asked the prosecution to “put their house in order as soon as possible.”

Magistrate Krubally informed the court that the matter had been mentioned last Friday and adjourned to today, July 5, 2023, for further mention, at which time the prosecution withdrew the case. The magistrate stated that the court had no choice but to accept the withdrawal of the case.

 “The matter is hereby struck out from the court,” Magistrate Krubally ruled. 

Aisha Fatty was previously charged with eight counts of theft contrary to Section 252 of the Criminal Code, Cap 10:01 Laws of The Gambia, at the Banjul Magistrate’s Court.

The prosecution alleges that Fatty stole a Mercedes-Benz GLE 63 Brabus black in color with registration number BJL 0999 W, valued at $240,000, from Motor Lands Company, which is owned by Abdoulaye Thiam.

Fatty is also accused of stealing a Mercedes-Benz GLE 53 Brabus, white, with registration number BJL 4222, valued at $102,000, from Motor Lands Company.

The prosecution further alleges that Fatty stole $380,000, equivalent to D19,500,000, from Thiam, which was intended to be used to purchase a property.

Fatty is also accused of stealing $150,000, equivalent to D7,696,500, which was given to her by Thiam for the purpose of constructing an office complex for their joint business.

In addition, Fatty is charged with stealing a total of 3,522.5 grams of gold, valued at CFA 123,305,500, and 5,745.93 grams of gold, valued at CFA 202,645,917, from Thiam.

Finally, Fatty is accused of stealing CFA 180,000,000, which was given to her by Thiam to purchase gold on his behalf for their joint business

In a previous interview with this medium , Aisha’s attorney, LS Camara, said that her client is prepared to defend herself in both the criminal and civil cases.
