Request To Remand Friendship Hostel “Murder” Suspect Granted

Principal Magistrate, Omar Jabang, Kanifing Magistrates’ Court granted the Police application seeking to remand at Mile 2 Prison, the Friendship Hostel “murder” suspect, pending trial at the High Court.

Appearing for the Police chief, Sub Inspector Kebbeh said the charge before the court is a “murder” case; then applied for the matter to be transferred to the High Court, saying “the Magistrates Court does not have the jurisdiction to hear the case”; pursuant to section 62 and 208A of the Criminal Procedure Code Cap10:01 volume lll Laws of the Gambia 2009.

The Sub Inspector further applied for the accused person to be remanded at the State Central Prison (Mile 2 Prison), pending the mention of the case at the High Court.

Responding to the application, the Principal Magistrate granted the application; and added that the charge before the court is a capital offence and that a capital offence can only be heard under the Special Criminal Division of the High Court of the Gambia under section 208 (A) of the Criminal Procedure Code.

He then ordered the accused person to be remanded at Mile 2 prison, pending the mention of the case at the High Court of the Gambia.

The suspect, Kumba Sinyan, a businesswoman was earlier Monday arraigned before Principal Magistrate Jabang on a single charge of the alleged murder of one Momodou Lamarana Jallow; contrary to 187, and punishable under Section 188 of the Criminal Code Cap: 10:01 Vol.III revised.

She is accused of killing the 25-year-old Jallow by cutting his stomach with a razor blade at the Friendship Hostel in Bakau on 14th September 2022.

The details of the charge stated that the accused on or about the 14th September 2022 at the Friendship Hotel in Bakau, in the Kanifing Municipality, in the Republic of the Gambia with malice aforethought, used a razor blade, and cut Momodou Lamarana Jallow ,aged 25 years on his stomach causing his death, thereby committed an offence.

The accused person was said to be in a relationship with her alleged victim at the time of the incident.
