State Files Motion to Keep Bojang Siblings in Custody

The legal proceedings surrounding Ousainou and Amie Bojang have taken a dramatic turn, as the State moves to prevent their release following their recent acquittal. Hours after a court granted them bail, the State filed an urgent Motion Ex-Parte seeking to keep the siblings in custody.

The motion, submitted on 31 March 2026 by Counsel S.L. Jobarteh on behalf of the State, aims to halt the execution of the bail order issued the previous day.

In an affidavit supporting the motion, Pupil Counsel Sisawo Cham argued that releasing the siblings presents an “extreme and imminent risk.” The State is requesting an immediate stay of the court’s order, which had allowed the siblings to be released on a D50,000.00 bail.

The State highlighted Ousainou Bojang’s “proven propensity for flight,” referencing his admitted travel to Senegal within 24 hours of the September 2023 shooting incident. Authorities contended that the current bail conditions—including a D50,000.00 bond and the deposit of an Identity Card—are insufficient for a suspect with a history of evading security checkpoints.

The affidavit also noted that Amie Bojang had previously admitted to assisting her brother in traveling to the border via hired transport.

The State is seeking a court order to remand the siblings at Mile 2 Central Prison pending a formal Motion on Notice. Emphasizing the seriousness of the case—which involves the deaths of Police Officers Sang J. Gomez and Pateh Jallow—the State argued that custody should be maintained while the acquittal is legally challenged.

“Public interest and national security dictate that persons accused of terrorism and the murder of security personnel should remain in custody until the legal challenge to their acquittal is addressed,” the affidavit stated.
